Terms of Service

Welcome to Murmur, a service operated by XPD Direct Inc. By accessing or using our platform at https://trymurmur.com, you agree to be bound by these Terms of Service (“Terms”). Please read them carefully.
1. Who We Are
Murmur is a brand monitoring platform that helps companies understand how their brand appears in AI platforms and language models. The service is provided by XPD Direct Inc., a company based in Quebec, Canada.
2. Eligibility
You must be at least the age of majority required by your local jurisdiction to use this service.
3. Account Creation
To use Murmur, you must create an account using a valid email address. You are responsible for maintaining the security of your account.
4. Fees and Billing
Murmur is a paid service. We charge a one-time fee that grants you access to the platform for 28 days. There are no free trials. If you have generated more than one report, you are not eligible for a refund.
5. Acceptable Use
You agree not to:
- Automate the generation of reports without permission
- Attempt to reverse engineer or extract proprietary logic from the platform
- Use the service for unlawful or unauthorized purposes
6. Intellectual Property
All rights, title, and interest in Murmur, including all content and code, are owned by XPD Direct Inc. You may not copy, modify, or distribute any part of the platform without permission. However, you may view, download, and share the reports you generate for your own business use.
7. User Data
You may be asked to provide company details, payment information, and queries to use the platform. This information is kept private and secure, and may be used in anonymized form to improve the functionality and accuracy of our system.
8. Service Modifications
We may modify, suspend, or discontinue any part of the service at any time with or without notice.
While we strive to maintain uninterrupted access, the service may occasionally be unavailable due to maintenance, updates, or technical issues. We are not responsible for any loss or inconvenience caused by such downtime and no compensation or credit will be issued for temporary unavailability.
9. Termination
You may terminate your account at any time. We reserve the right to retain your data unless you request deletion via email at info@xpd.ca.
10. Limitation of Liability
To the fullest extent permitted by applicable law, XPD Direct Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of or inability to access or use the service; (b) any conduct or content of any third party on the service; (c) any content obtained from the service; and (d) unauthorized access, use, or alteration of your transmissions or content.
11. Disclaimer of Warranties
Murmur is provided “as is” and “as available” without warranties of any kind, either express or implied. We do not guarantee that the service will be uninterrupted, error-free, or completely secure. To the fullest extent permitted by law, XPD Direct Inc. disclaims all warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.
12. Indemnification
You agree to indemnify, defend, and hold harmless XPD Direct Inc., its officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, or expenses, including reasonable legal fees, arising out of or in any way connected with your access to or use of the Murmur platform, your violation of these Terms, or your infringement of any third-party rights.
13. Governing Law and Dispute Resolution
These Terms are governed by the laws of Quebec, Canada. Any disputes will first be resolved through arbitration. If unresolved, they will be handled in the courts of Quebec.
